In the name of God Amen. The 23rd day of August in the year of our Lord God one thousand five hundred sixty and one [23/8/1561] and in the third year of the reign of our Sovereign Lady Elizabeth by the grace of God Queen of England France and Ireland defender of the Faith etc.  I JOHN NEWTON of Barres Court in the county of Gloucestershire Knight being of good mind and perfect remembrance thanks be to God do make this my present testament wherein is contained my last will revoking hereby all former wills by me made at any time.  First and [] I bequeath my soul to Almighty God my Maker and Redeemer that through the death and Passion of his dear son I shall obtain pardon and forgiveness of all my sins and offences who hath borne my infirmity in the altar of the cross [] to all faithful penitent sinners remission  through faith in his blood by that one only oblation once offered being a sufficient whole [] and oblation for the sins of the whole world; and my body to be buried in the parish church where it shall please almighty God to call me out of this transitory life.  ITEM; I do give and bequeath to the maintenance of the reparations of the parish church of Esterpfrye twenty shillings.  ITEM; I give and bequeath to each of my daughters as shall happen to be unmarried at the time of my death to every of them one hundred pounds of good and lawful money of England.  ITEM; my will is that if it shall happen any of my daughters to be married or contracted in my lifetime and before that they shall happen to be paid of their said legacy it shall happen me to die then I will they shall have every of them one hundred pounds.  And for that there may a doubt or question be of my daughters who they be that shall receive this my bequest and legacy I therefore think it good by this my present testament to explain and openly name my said daughters those who shall by this my present testament have and receive every of them one hundred pounds as is aforesaid; I will that JANE NEWTON, BRIDGET NEWTON, GRACE NEWTON, THEOPHIL NEWTON, THEODOSIA NEWTON AND NAZARETH NEWTON, my daughters, who be now unmarried to have the same. Also I will that my executors hereafter named in this my present testament or the [overly] of them shall content and pay of the rent revenues issues and profits of my manors land tenement hereafter limited and appointed in this my present testament for and to the performance of this my last will and testament to my said daughters before named at such time and times as shall be thought good and declared by my executors and my overseers of this my last will. And as to the devising willing distributing and disposing of all and every my Lordships manors lands tenements rents reversions [] and hereditaments wherein or in the which I have any manner of estate of inheritance in possession remainder or otherwise I do ordain and declare by this my present testament and last will in manner and form following.  First for the true payment of all my debts which I am indebted or do owe top any person or persons to whom generally our debts or duties of right ought to be paid by me the said Sir John Newton and also for and to the contentation true payment satisfaction fulfilling executing and performing of all and every my bequests and legacies before or hereafter in this present mentioned willed or bequeathed unto my executors hereafter named in this my present testament and last will all those and every my Lordships manors lands tenements rent reversions [] and hereditaments set lying and being in the towns fields hamlets and tything of Bageworth Marke or Tornycke Overwere and Netherwere or by any of the said names with all and singular their appurtenance with all lands tenements meadows leasures pastures woods underwoods commons rents and reversions [] and hereditaments to have and to hold all and every my said Lordships manors lands tenements meadows leasures pastures woods underwoods commons rents reversions [] and hereditaments with all their appurtenances unto my said executors hereafter named until that time that all my debts duties legacies and bequests and every of them in this present mentioned or comprised and every clause article and thing in this my present last will and testament contained or specified be or shall be according to the true meaning and intent of the same contented paid fulfilled and done. And after that my said debts legacies and bequests shall be fully contented satisfied and paid as my said will doth specify and declare, that then I will all the said manors lands tenements hereditaments aforesaid shall remain come and be unto my eldest Son according to the order and course of the common laws of this Realm to have and to hold all the said manors and all other the foresaid hereditaments with their appurtenance unto my son and heir and his heirs and assigns forever as though this devise and testament had never been had or made, Provided always and also I will that the aforesaid Jane Newton Bridget Newton Grace Newton Theophila Newton, Theodosia and Nazareth Newton my daughters before named at all and every time and times in and concerning the marriage of any of them and in and concerning all and every other thing and things be ordered and ruled by my executors and overseers and of the longer liver or longer livers of of them therein; And that the said Jane Bridget Grace Theophila Theodosia and Nazareth Newton my said daughters shall at all and any time from time to time stand observe fulfill and obey on and concerning every thing and things and all and every order and determination had made or to be taken by my said executors overseers or by the longer livers or longer liver of them.  Anything in this present to the contrary notwithstanding.  [] or concerning the living behaviours demeanours marriage and habitations of my said daughters and of every of them dwell every of the said legacies and bequests from thenceforth cease and be utterly determined and void against any of them which shall disobey infringe or break any such order or determination as shall be had made or taken by my said executors and overseers or by the longer livers or longer liver of them.  And all and every my land and tenement called or known by the name or names of CATROTE ESTHERPFRY SHEROLL COLLEY HENTON BLEWER LYTTON SHEREBORNE ESTWOOD CHEWTON SLAPE and BEDMINSTER and of and on all those lands and tenements late in the tenure of Thomas Webbe  of Westerfry deceased in the county of Somerset I have before this time by sundry and fundamenting and deeds made and conveyed divers and sundry lawful estates assurance and conveyance to the use of myself and of Dame MARGARET my wife for her jointure and of any heirs and assigns forever as by uses of the same with [] writing more at large it doth appear. And for the more perfect assurance to be had and made to the said Dame Margaret my wife of the said manor land tenement and hereditament last before mentioned whereof the uses be plainly and expressly limited and declared to be to the use of myself and the foresaid Margaret and of my heirs as is aforesaid by or in the said writing or deeds by me had or made concerning the said manors land tenement and hereditament or concerning the uses of the same.  I will and declare by this present that the said Dame Margaret my said wife shall have the same manors land tenement and hereditament whereof the uses be plainly and expressly limited and declared to be to the said Margaret by and in the said deeds and writing unto the said uses of the said manors land tenements and hereditaments to her by or in the said deeds and writing plainly and expressly to her limited and declared.  And of the Manor of Westharmansworth with the appurtenance in the parish of Bilton in the county of Gloucester or of the Manor of Charlecombe with the appurtenance in the parish of Charlecombe beside Bath in the county of Somerset or of my land tenements or hereditaments in Prydy Estcharptry Westharptry in the said county of Somerset which are now be let or demised by deed indented to one William Chauncells and John his son for term of certain years if they so long like which said [premises] I did lately purchase the fee simple of Sir Thomas Horne Knight deceased which said manors land tenements and hereditaments last before mentioned in the counties of Gloucester and Somerset be of the yearly value of fifty and two pounds three shillings; I have not made suffered or conveyed any other estate assurance or conveyance but only such leases demises or grants thereof had or made for like year or years by copy of [] roll indentures or otherwise upon all and every which demises and grants the [] yearly rent or more be reserved or yearly to be paid during the said several estates leases or grants thereof had or made nor I do not declare or make my last will or testament thereof but do permit and suffer the same value of fifty six pounds three shillings to descend and come to my next heir according to the course of the Common Law to the intent that the queen’s highness and any other Lord or Lords of whom the same beholden may have thereof such advantage and benefit as the queen’s highness her heirs and successors or any other of the Lords of right and by the laws and statutes of this realm ought to have.  And further I will that my executors or the survivor of them shall yearly during their lives and the longest liver of them from year to year once in the year at such time as by my overseers hereafter named shall be appointed of this my last will and testament and by the survivor of them shall yield and make a true account and reckoning of every the foresaid manors lands tenements and hereditaments to my said overseers hereafter named or the survivor of them and of all rent revenues issues commodities and advantages to be had secured or taken in or upon every or any the foresaid premises to my said executor limited. And that my said overseers shall have and the survivor of them shall have full power and authority to allow unto them all such charge as my said executors shall pay sustain or be at or to have paid allowed or satisfied in about or concerning the execution and performing of this my last will and testament or any part thereof. And that every of my overseers being present at or about the making of every of the said accounts or any of them shall have out of the said hereditaments to my executors willed six shillings eight pence once in every year to be taken until this my last will and testament be and shall be fully performed. Provided always and also I will and declare by this my present that all variance and strife hereafter that may be had or grow of or upon any matter herein contained confining named or by the survivor of them. And I do ordain constitute and make Dame Margaret my wife and HENRY NEWTON my son and heir apparent my sole and whole executors entirely desiring them that they will execute perform and fulfil this my present testament and last will in all things according to my mind will and intent as my special trust is in them so to do. And the residue of my goods and chattels I give and bequeath to my said executors. And to be my overseers of this my present testament and last will I do by these presents ordain name and make Richard Poyntes knight and the Bishop of Bath for the time being desiring them that they will assist and aid my executors and to be my overseers of this my present testament and last will according to the true meaning and intent of the same; and for their pains and diligence by my said overseers to be taken in and about the executing of this my present testament and last will I do will and bequeath to every of them five pounds over and above all their charges and expenses. And also that they will aid and help my said executors and my children before mentioned in their right per me John Newton
